No-Refund and Intellectual Property Protection Policy

Statement of Principles

This policy establishes the conditions under which Panda Studio (operating as Panda15Fps, Panda Mania, Panda Development and any associated brand) provides software development, systems, games and custom technology services.

1. Irreversible Nature of Digital Products

No-refund policy

By hiring Panda Studio services, the client expressly accepts that NO REFUNDS WILL BE GRANTED under any circumstance, including:

• The client changing their mind about the design, functionality or approach of the project.
• Subjective dissatisfaction with the final result (as long as it meets the agreed specifications).
• The client's technical difficulties implementing or using the delivered product.
• Changes in the client's business model that make the product unnecessary.
• Loss of interest in the project or lack of budget to complete it.
• Unilateral cancellation of the project by the client without justified cause.

Protected payment structure

• Initial deposit (50%-70%): Completely NON-REFUNDABLE. It compensates the developer's risk and secures the client's commitment.
• Final payment (30%-50%): Mandatory before delivery of final files.
• Partial / milestone payments: Once paid, they are final and irreversible.

Only legally valid exception

A partial refund will be evaluated ONLY if ALL of these conditions are met SIMULTANEOUSLY:

• Panda Studio completely fails to deliver what was agreed in the signed contract.
• The client has fulfilled all their obligations.
• No viable technical solution exists for causes attributable exclusively to Panda Studio.
• The client provides irrefutable documentary evidence of the breach.
• Every mediation process has been exhausted without success.

Even in this case, the refund is proportional to the work not performed, minus administrative costs (minimum 15%). The process can take up to 60 business days.

2. Prohibition of Fraudulent Chargebacks

Mandatory protocol before any dispute

• Send formal written notice to pandacyd.programmer@gmail.com describing the problem in detail.
• Provide documented technical evidence (screenshots, logs, videos, error files).
• Allow a minimum of 10 business days for a response and technical resolution.
• Participate in good faith in a mediation process.

Consequences of a fraudulent chargeback

• Total license revocation: The client loses every legal right to use, run, modify or distribute the delivered software.
• DMCA enforcement on every platform where the client published the product (Roblox, Steam, GitHub, etc.).
• Permanent blacklist: The client can never hire Panda Studio services again.
• Civil and criminal legal action for electronic fraud under the Peruvian Criminal Code.

3. Copyright and Intellectual Property

Copyright ownership

Panda15Fps (Panda Studio) is the sole and exclusive original holder of all intellectual property rights over source code, architecture, assets, documentation and methodologies developed. This authorship is protected by Legislative Decree No. 822 and the Berne Convention.

Serious infringements

• Unauthorized redistribution: Selling, renting, licensing or distributing the code to third parties without written authorization.
• Authorship falsification: Claiming to be the original creator or removing credits, comments or identification marks from the code.
• Unauthorized commercial use: Using a Personal License product for commercial purposes.
• Modification intended to hide authorship: Superficial changes to pretend the code is different or to remove tracking systems.

Tracking systems and technical protection

All products include code watermarking, unique identifiers, console signatures and cryptographic checksums. Removing these systems constitutes an additional violation with premeditated malicious intent.

4. Consequences of Violation

Immediate administrative sanctions

• Permanent ban from hiring Panda Studio services (lifetime blacklist).
• Revocation of every usage license for previous products.
• Block on every official communication channel.

Civil legal action

• Minor infringement (limited non-profit redistribution): USD $2,000 - $5,000
• Moderate infringement (unauthorized commercial use): USD $5,000 - $15,000
• Serious infringement (authorship falsification + profit): USD $15,000 - $50,000
• Very serious infringement (mass redistribution): USD $50,000+

Criminal action

• Article 207-C (Computer Fraud): 3 to 8 years imprisonment + fine.
• Article 216 (Copyright Infringement): 2 to 6 years imprisonment + fine.
• Article 217 (Aggravated Forms): 4 to 8 years if organized or at large scale.

5. Jurisdiction and Applicable Law

• Panda Studio location: Ventanilla, Callao, Peru.
• Exclusive jurisdiction: Courts of Lima, Peru.
• Applicable law: Legislative Decree No. 822, Peruvian Civil Code, Law No. 29733, Berne Convention, WIPO Copyright Treaty, DMCA.
• Official language: Spanish. In case of translations, the Spanish version prevails.

Summary of Prohibitions and Permissions

Absolutely prohibited

• Requesting refunds for change of mind or subjective dissatisfaction.
• Starting chargebacks without previously contacting Panda Studio.
• Redistributing, selling or publicly sharing code without authorization.
• Removing author credits from code, console or documentation.
• Claiming false authorship.
• Using a product commercially without a commercial license.

Allowed and encouraged

• Using the product according to the acquired license terms.
• Integrating the code into your own projects while respecting the license.
• Contacting support within 30 days post-delivery.
• Requesting a quote for additional modifications.
• Crediting Panda Studio as the original developer in public documentation.
• Reporting legitimate technical problems with evidence.
